These Terms and Conditions (“Terms”) govern your access to and use of firefliesperformancecostumes.com (the “Site”), our brick-and-mortar showroom, social-media channels, and any purchase, fitting, or custom-design service we provide (collectively, the “Services”). By visiting the Site, booking an appointment, or placing an order, you agree to be bound by these Terms and by our Privacy Policy. If you do not accept every provision, please refrain from using our Services.

1. Eligibility & Account Responsibility

• You must be at least 18 years old (or the age of majority in your jurisdiction) to place an order or create an account.
• You agree to provide accurate, current, and complete information and to keep your login credentials secure. You are responsible for all activity under your account.

2. Product Information & Availability

• Ready-to-Ship Items are one-of-a-kind or limited-run pieces; sizes and colors may vary slightly from on-screen images due to lighting and monitor settings.
• Custom Designs require your measurements, music theme, and color preferences. Final sketches and embellishment layouts must be approved in writing (email is sufficient) before production begins.
• We reserve the right to discontinue any product or adjust inventory without notice.

3. Pricing & Payment

• All prices are listed in U.S. dollars and are subject to change without notice.
• We accept Visa, MasterCard, American Express, Discover, and Apple Pay through Square, our PCI DSS Level 1 payment processor. Fireflies never stores raw card data.
• Sales tax is calculated at checkout based on your shipping address.

4. Ordering Process

1. Add items to cart and proceed to checkout.
2. Review your order summary, including shipping fees and tax.
3. Submit payment through Square’s secure gateway.
4. You will receive an email confirmation. Orders are not binding until we dispatch an “Order Shipped” email.
5. We reserve the right to refuse or cancel any order (e.g., suspected fraud, pricing error). If we cancel, you will receive a full refund.

5. Shipping & Delivery

• We ship within the United States only via USPS, UPS, or DHL.
• Ready-to-ship items leave our studio within 1–3 business days; custom orders ship in 4–6 weeks unless otherwise quoted.
• Risk of loss transfers to you upon carrier hand-off.
• Shipping times are estimates, not guarantees; carrier delays are beyond our control.

To start a return, email contact@firefliesperformancecostumes.com with your order number. Approved refunds are credited to the original payment method within 7 business days of our receipt.

7. Custom-Design Agreement

• Measurements & Fit: You are responsible for submitting accurate, current measurements. We accommodate a ±½-inch tolerance.
• Design Changes: One round of minor changes is included before production; substantial alterations may incur additional fees and extend timelines.
• Rush Orders: Requests under 3 weeks are subject to availability and a non-refundable rush fee quoted case-by-case.
• Artistic License: We strive to match approved sketches, but crystal patterning and dye lots may vary slightly due to hand craftsmanship.

8. Promotions, Coupons & Gift Cards

• Discount codes cannot be combined, applied to prior purchases, or redeemed for cash.
• Gift cards are digital, non-refundable, do not expire, and are treated as cash during checkout.

9. Intellectual Property

All content on the Site—including text, graphics, logos, photos, videos, and dress designs—is the exclusive property of Fireflies or its licensors and is protected by U.S. and international IP laws. You may view and print material for personal, non-commercial use only. Any other use (e.g., reproduction, distribution, derivative works) requires our prior written consent.

10. User-Generated Content

By posting reviews, photos, or comments, you grant Fireflies a non-exclusive, royalty-free, worldwide license to reproduce, modify, and display that content for marketing or promotional purposes. You represent that you own or control all necessary rights and that your submission is not defamatory, obscene, or infringing.

11. Third-Party Links & Tools

The Site may link to external websites (e.g., social-media platforms, pattern-inspiration boards). We provide these links for convenience only; we do not endorse and are not responsible for third-party content or practices. Your interactions with those sites are governed by their terms.

12. Disclaimer of Warranties

OUR PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” EXCEPT AS EXPRESSLY STATED, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Some jurisdictions do not allow disclaimer of implied warranties, so the above may not fully apply to you.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIRELIES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES (INCLUDING LOST PROFITS, DATA, OR GOODWILL) ARISING FROM THE USE OF OUR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT IN DISPUTE.

14. Indemnification

You agree to indemnify, defend, and hold harmless Fireflies and its owners, employees, and agents from any claims, damages, or expenses (including attorneys’ fees) arising from your breach of these Terms or your misuse of the Services.

15. Governing Law & Dispute Resolution

These Terms and any dispute shall be governed by the laws of the State of Minnesota, without regard to conflict-of-laws rules.

• Informal Resolution: Contact us first at contact@firefliesperformancecostumes.com; most issues are resolved quickly.
• Small-Claims & Arbitration: If not resolved informally, disputes may be brought in Wright County small-claims court or, by mutual agreement, resolved through binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association.
• Class-Action Waiver: You may only resolve disputes with us individually and may not bring a claim as a plaintiff or class member in a class, consolidated, or representative action.

16. Termination

We reserve the right to suspend or terminate your account or access to the Services at our sole discretion, without notice, for behavior that violates these Terms or harms other users.

17. Changes to These Terms

We may update these Terms from time to time. Revisions become effective when posted on the Site. Material changes will be highlighted for at least 30 days. Continued use of the Services after changes constitutes acceptance.

18. Severability

If any provision of these Terms is deemed unlawful or unenforceable, the remaining provisions will remain in full force.
